1. Agreement to Terms

By accessing or using the AcuTrader website (acutrader.com) and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

AcuTrader provides trading indicator software for the TradingView and NinjaTrader platforms. Our indicators offer buy and sell signal visualization through color-coded candlesticks, entry/exit markers, trend identification, and stop-loss levels.

AcuTrader is a software tool, not financial advice. Our indicators are designed to assist with technical analysis. They do not constitute investment recommendations, trading advice, or any form of financial guidance.

3. Account Registration

  • • You must provide a valid email address to use our services.
  • • You must be at least 18 years of age.
  • • You are responsible for maintaining the security of your account and for all activity that occurs under it.

4. Subscriptions and Billing

  • • All subscriptions and payments are managed by Paddle, our merchant of record. Paddle's terms of service apply to all payment transactions.
  • • We offer monthly and annual billing options.
  • • Subscriptions automatically renew at the end of each billing period unless cancelled.
  • • We may change subscription prices with advance notice. Existing subscribers will be notified before any price change takes effect.

5. Cancellation and Refunds

  • • You may cancel your subscription at any time through the customer portal or directly through Paddle.
  • • Upon cancellation, you will retain access to the indicators until the end of your current billing period.
  • • Refund requests are handled on a case-by-case basis. Contact support@acutrader.com for refund inquiries.
  • • If a refund is issued, your indicator access will be revoked immediately.

6. Platform Access

  • • TradingView — Access is granted as an invite-only indicator on your TradingView account. You must provide your TradingView username.
  • • NinjaTrader — Your license is provisioned through the NinjaTrader Ecosystem. You must provide the email address associated with your NinjaTrader account.
  • • AcuTrader relies on third-party platforms (TradingView, NinjaTrader) for indicator delivery. Access is subject to those platforms' availability and terms of service.

7. Intellectual Property

  • • AcuTrader indicators are proprietary software. All rights, title, and interest in the software remain with AcuTrader.
  • • Your subscription grants you a non-transferable, non-sublicensable license to use the indicators for personal trading purposes only.
  • • You may not reverse engineer, decompile, redistribute, resell, or share access to our indicators with others.

8. Trading Risk Disclaimers

AcuTrader is not a financial advisor, broker, or dealer. Our indicators are software tools designed for technical analysis. They do not constitute trading recommendations, investment advice, or any form of financial guidance. All trading decisions are your own.

Risk Disclosure

Futures and forex trading contains substantial risk and is not for every investor. An investor could potentially lose all or more than the initial investment. Risk capital is money that can be lost without jeopardizing ones' financial security or life style. Only risk capital should be used for trading and only those with sufficient risk capital should consider trading. Past performance is not necessarily indicative of future results.

Hypothetical Performance Disclosure

Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown; in fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk of actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all which can adversely affect trading results.

9. Limitation of Liability

  • • To the maximum extent permitted by law, AcuTrader's total liability is limited to the amount you have paid us in the 12 months preceding the claim.
  • • AcuTrader is not liable for any trading losses, lost profits, or financial damages arising from the use of our indicators.
  • • AcuTrader is not liable for any outages, downtime, or service interruptions of third-party platforms (TradingView, NinjaTrader, or others).
  • • Our services are provided "as is" and "as available" without warranties of any kind, express or implied.

10. Indemnification

You agree to indemnify and hold harmless AcuTrader, its owners, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your violation of these terms, or any trading activity you undertake using our indicators.

11. Termination

  • • We may suspend or terminate your access if you violate these terms.
  • • We may terminate your account for non-payment or persistent payment failures.
  • • Upon termination, your indicator access will be revoked immediately and you will have no further right to use our software.

12. Third-Party Trademarks

  • • NinjaTrader® is a registered trademark of NinjaTrader Group, LLC. No NinjaTrader company has any affiliation with the owner, developer, or provider of the products or services described herein, or any interest, ownership or otherwise, in any such product or service, or endorses, recommends or approves any such product or service.
  • • TradingView is a trademark of TradingView Inc. AcuTrader is not affiliated with or endorsed by TradingView Inc.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the applicable jurisdiction. Any disputes arising from these terms or your use of our services will be resolved in the courts of the applicable jurisdiction.

14. Changes to Terms

We may update these Terms of Service from time to time. We will notify active subscribers of material changes via email. Your continued use of our services after changes take effect constitutes acceptance of the revised terms.
